Server Terms
These terms cover VPS, VDS and dedicated servers purchased through CloudHosting.lu. They apply with the Service Terms, Billing, Cancellation and Refund Policy and Acceptable Use Policy.
1. Configuration and provisioning
Your order specifies the resources, software, licences, service period and management level purchased. Check that these meet your requirements before ordering. Provisioning begins after acceptance and any required payment or verification. A requested configuration or estimated delivery time is not a guaranteed commitment unless expressly agreed.
For unmanaged servers, you are responsible for the operating system, applications, patching, firewall, credentials and backups except for any feature expressly included in the order. Where root or administrator access is supplied, changes you make can affect security, recoverability and support.
2. Managed servers
Managed server services are available to business and professional customers only. The Managed Services Terms and 352 Digital Terms & Conditions govern the managed work. Your order defines the access provided and the administration tasks included.
An infrastructure specification does not imply unlimited application support. Work outside the agreed management scope is quoted separately. Any expressly agreed infrastructure availability or service commitment remains applicable.
3. Service periods and cancellation
Provisioning commits resources and may incur supplier and licence charges. We do not offer a voluntary trial or money-back guarantee. Once a server is provisioned, we do not provide a change-of-mind refund for the agreed service period, including unused time following an early cancellation.
The minimum term, renewal period and cancellation deadline stated for your service apply. Cancellation does not cancel separately committed licences or other products unless their own terms permit it. We will identify those commitments before purchase. Statutory rights and remedies for an unfulfilled order, a billing error or our breach are not excluded.
4. Backups, maintenance and availability
Backups are included only where stated in the plan or order. A snapshot or redundant disk is not a substitute for an independent backup. The Backups Policy describes restoration requests and retention.
The Service Level Agreement explains infrastructure availability commitments. A specific higher commitment in your order remains applicable. Maintenance follows our Server Maintenance Policy. Customer-managed software problems are outside the infrastructure commitment unless expressly included in the management scope.
5. Security and misuse
Keep systems secure and respond promptly to an abuse or security notice. We may block traffic, restrict access or suspend a server where reasonably necessary to address a breach or material risk under the Acceptable Use Policy. Serious or repeated abuse can result in termination.
Export your data before the service ends. Any migration or handover work beyond your order is subject to a separate agreement. Termination, data deletion and any lawful preservation of evidence are handled under the applicable policies and law.
