Managed Services Terms
All managed services are available only to customers purchasing for their business or professional activity. They are supplied by 352 Digital S.à r.l. under the 352 Digital Terms & Conditions, together with the applicable policies linked from 352 Digital’s legal page.
1. Services covered
This includes managed hosting, managed WordPress, managed servers, managed Nextcloud, maintenance, configuration, consultancy, managed marketing and other ongoing management work included in your order. You must identify the business or professional customer when ordering and have authority to act for it.
Your accepted quotation or order defines what we manage, the fees, service period, access rights and any specific commitments. Work not included in that scope may be quoted separately. The technical features of a product do not imply that every application, integration or task is managed.
Company name is required when ordering a managed service. You are responsible for providing the correct company or professional trading name, accurate customer details and truthful information about the business purpose of the purchase. You must have authority to place the order for that customer and keep its details current. Materially false details may justify refusal of an order or proportionate restriction or termination under the applicable terms and law. A false declaration does not remove obligations imposed on either party by mandatory law.
2. How the agreements work together
A specific commitment expressly agreed in your quotation, order or applicable service schedule takes precedence over a conflicting general provision. The 352 Digital terms govern the managed work. CloudHosting.lu’s product terms govern separately supplied domains, infrastructure and third-party products.
For example, a monthly term, a particular access right or an infrastructure SLA expressly included in the accepted order remains effective. The 352 Digital default provisions apply where no different specific term has been agreed. Nothing in these documents overrides mandatory law.
3. Fees, renewal and cancellation
The term and cancellation arrangements in your accepted order apply. Where the order does not provide otherwise, the relevant default provisions in section 7 of the 352 Digital terms apply, including annual hosting, maintenance and licence terms and the notice required before renewal.
We do not offer a voluntary money-back guarantee. Managed service periods and committed third-party products are not refundable merely because you change your mind, stop using the service or cancel early. Amounts properly due for work performed and agreed commitments remain payable. Refunds or other remedies required by law or an express contractual commitment are unaffected.
4. Cooperation and security
Provide the information, permissions and access needed to carry out the agreed work. Tell us before making changes that may affect a managed system, and keep the access available to you secure.
The Acceptable Use Policy applies throughout. Its urgent protective measures and serious-abuse termination provisions apply to the affected CloudHosting.lu services without requiring a waiting period that would leave harmful activity running.
5. Backups, support and personal data
Your order determines the included backup and support arrangements. Read the Backups Policy and Support Policy with those service-specific commitments. An infrastructure uptime commitment does not create an application support or repair deadline unless expressly agreed.
Personal-data processing follows the applicable privacy policy and any required data-processing agreement. Keep independent copies of important business data. Migration, handover and deletion at the end of the service follow your accepted agreement and mandatory legal obligations.
